Terms of Service

By commissioning me, you are agreeing to my Terms of Service, which are as follows. I am not responsible for a client(s) misinterpreting the terms, nor if I am misled about your ability to comply, such as lying about your age.
You must be at least 18 years of age, or have a parent/guardian able to provide permission to do so. This applies regardless of whether or not the commissioned content is "child friendly" or "adult" in nature.

For any questions or concerns about commissioning me, my terms of service, or anything else related to business, please feel free to just contact me! I'm happy to answer questions and make clarifications as best I can.
I can be reached at Detaryu on Furaffinity (Private message me!) -- Detaryuu@gmail.com for emails -- Detaryu on Discord -- and Detaryu on Bluesky! The best of these to contact me on is Discord or Furaffinity.

I reserve the right to refuse any commission, for any reason, with or without explanation from myself. I do not discriminate based on the client's racial, sexual, gender, or other such protected statuses, but I am not obligated to work for a commissioner I am personal uncomfortable with, nor work with subject matter I am personally uncomfortable with. I am a strictly LGBTQIA+ friendly artist, and will not work with anyone who displays or is known to display hateful behaviors towards the LGBTQIA+ community, directly or conceptually.

My prices are all listed in USD, and currently can accept payment via Paypal invoices (Please do not try to send me money directly via the friends/family function!) or via Kofi.
I can provide a rough estimated time expectation at the client's request for a piece, mostly based upon if there's a queue ahead of your piece. I will communicate with you in the most timely manner possible should I encounter any unusual delays of my own responsibility (such as technical difficulties, personal delays, power outages, etc) and am not accountable for delays in the process related to the commissioner (for example, if I send an update to await approval to continue and the client does not respond to me for a week, that wait time is not my responsibility.) Should the client want a piece done by a specific due date, it is their responsibility to communicate that to me before the commission or as soon as reasonably possible, so that I may be able to tell you if I should be able to complete the work on time. That is to say, if you need a full shaded portrait of 12 characters done in a week, I need to know before agreeing and taking any payment, as if I have a pending queue or something personally going on that would prevent me from being able to dedicate that entire time to working, I would be unable to meet the requirement. If you start a commission with me and do not mention needing it done by a certain time, but due to circumstances out of our control there's a delay that concerns you it may not be done (such as ordering far ahead of time for a birthday gift, and I have a power outage or some such event the week before) please just tell me as soon as you can, so I can best try to give you a reasonable estimate on if I'm able to meet your needs.

Should the commissioner want or need a refund for any reason, they may recieve a full refund for a piece paid for but not copmleted, and partial refunds if the piece has been only sketched or lined. Should the work be in the sketch stage, but lines not begun, the commissioner may recieve a 75% refund (rounding up to the nearest USD cent.) Should the work be in the line stage, but colors not yet being applied, the commissioner may recieve a 50% refund (rounding up to the nearest USD cent.) Should the work be in the coloring or shading stage, it is no longer eligible for a refund, as the vast majority of the work is already complete. At this point, you are within your rights to ask me to stop working on and not finish the piece, or let me finish it, but it is not eligible for refund.

I request payment be made up front, when I am no more than roughly 2 weeks out from being able to feasibly start your commission. (This may change in the future, but for now, it's to prevent potentially getting a backlog I cannot keep up with.) For orders over 100 USD, I allow partial payment up front (of at least 50%, amount may be more flexible for repeat clients I've become familiar with) and the rest upon completion, unless otherwise discussed and agreed upon. I require discussion of agreements overall be made in text, with exceptions only made for friends or long term clients, as a safety precaution for all parties involved, should there be any dispute of previously agreed terms.

On completion of your commission, you are completely free to use it for personal use, such as sending it privately to others, getting it printed specifically for display in your home or a function that it is not for sale, uploading it to your gallery (Please credit back if you do this, thank you!) or otherwise just about anything that doesn't count as commercial use - HOWEVER, at no point do I grant permission for my work to be used in the training of AI, be edited or 'fed' to an AI, or be used for NFTs of any variety. For reference sheets, please mention ahead of time if you'd like a copy of an editable .psd file, which I can provide free of charge to you for easier personal edits of your design(s).
